1. Introduction

Welcome to Williamsburg Art Conservation ("Company", "we", "our", "us"). These Terms and Conditions ("Terms", "Terms and Conditions") govern your use of our website and services offered by Williamsburg Art Conservation.

By accessing our website and using our services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access our services.

2. Services Description

Williamsburg Art Conservation provides professional art conservation, restoration, analysis, and preservation services for various types of artworks and cultural heritage objects. Our services include but are not limited to:

  • Conservation Analysis
  • Material Testing and Research
  • Conservation Treatment and Restoration
  • Collection Surveys and Assessments
  • Preventive Conservation Guidance
  • Technical Examination and Documentation

Services are provided by trained professional conservators in accordance with professional standards and ethics in the field of art conservation.

3. Service Agreements

All conservation services are provided according to a written proposal or estimate that must be approved by the client before work begins. The proposal will outline the scope of work, estimated timeline, and costs associated with the services.

Clients agree that any changes to the scope of work must be agreed upon in writing. Any alterations to the agreed-upon services may result in additional charges and extended completion timelines.

The client acknowledges that conservation treatments may involve inherent risks, and while we exercise the highest level of professional care, we cannot guarantee specific outcomes. Historical materials may respond unpredictably to treatments in some cases.

4. Payment Terms

Payment terms are as follows:

  • A non-refundable deposit of 30% of the total estimated cost is required to secure your appointment and commence work.
  • For treatments exceeding $5,000, progress payments may be required at predetermined milestones detailed in your proposal.
  • The remaining balance is due upon completion of services and before the return of artwork or delivery of final reports.
  • For long-term projects, alternative payment schedules may be arranged and will be detailed in your service agreement.

We accept payment via credit card, bank transfer, or check. A 3% processing fee applies to credit card payments for amounts over $1,000.

5. Cancellation Policy

Appointments or service agreements may be canceled or rescheduled with the following conditions:

  • Cancellations made more than 14 days before a scheduled appointment will receive a full refund of any payments made, less the non-refundable deposit.
  • Cancellations made less than 14 days before a scheduled appointment will be charged 50% of the quoted service fee.
  • Cancellations of services after work has commenced will be billed for all work completed to date plus 15% of the remaining project balance.

Williamsburg Art Conservation reserves the right to cancel or reschedule appointments due to unforeseen circumstances. In such cases, we will make every effort to provide alternative arrangements.

6. Artwork Transportation and Storage

Unless otherwise arranged, clients are responsible for the transportation of artworks to and from our facilities. We can recommend professional art handlers upon request.

While artworks are in our possession, we maintain appropriate insurance coverage. However, clients are encouraged to maintain their own insurance coverage as well. A waiver may be required for extremely valuable or fragile items.

After service completion, artworks must be collected within 30 days of notification. Items not collected within this timeframe will incur storage fees of $15 per day for small items and $30 per day for large items. Items not collected after 90 days may be considered abandoned.

7. Intellectual Property

Williamsburg Art Conservation retains all intellectual property rights to documentation, reports, analysis findings, treatment methodologies, and photographs created during our services, with the following provisions:

  • Clients receive a perpetual, non-exclusive license to use the documentation and reports provided for their personal records, insurance purposes, and provenance documentation.
  • We reserve the right to use images of artworks before, during, and after treatment for educational, promotional, and research purposes, unless specifically prohibited in writing by the client.
  • Client confidentiality will be maintained in all public presentations of work.

Upon request and with appropriate attribution, we may grant permission for clients to use our documentation in publications, exhibitions, or other public presentations.

8. Confidentiality

We maintain strict confidentiality regarding all client information, artwork details, and conservation findings. Information will not be shared with third parties without your consent except as required by law or professional ethics codes.

In cases where significant findings might impact the authentication, attribution, or value of an artwork, we may advise clients on appropriate disclosure responsibilities in accordance with professional ethical guidelines.

9. Limitation of Liability

While we exercise the highest standard of care in handling and treating artworks, Williamsburg Art Conservation's liability is limited to the amount paid for our services. We are not liable for:

  • Pre-existing conditions or inherent vulnerabilities in the artwork
  • Damages occurring during transportation arranged by the client
  • Changes in appearance that are an unavoidable result of necessary conservation procedures that were discussed and approved in advance
  • Consequential damages, including but not limited to loss of use or value

Any claims regarding the quality of work must be made in writing within 30 days of service completion.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions.

Any disputes arising under or related to these Terms shall be resolved exclusively in the courts of Williamsburg, Virginia. Both parties consent to the personal jurisdiction of such courts and waive any objections to the exercise of jurisdiction by such courts.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes indicates your acceptance of the revised Terms.

We will make reasonable efforts to notify clients of significant changes through email or notices on our website.
